1. Introduction
1. These Terms and Conditions ("Terms") govern your access to and use of Darasa website and services ("Service"). You agree to be bound by these Terms by accessing or using the Service.
2. Eligibility
- To use the Service, you must be at least 13 years old and have the legal capacity to enter into a binding contract.
- If you are accessing the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account and password.
- You are fully responsible for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Service Use
For Teachers
- Assessment Creation: Teachers are allowed to create assessments using the provided question bank, upload full papers to the platform, and utilize the system to generate quick assessments automatically.
- Revenue Share: The platform adheres to a 60/40 revenue share model where content creators receive 60% of the revenue generated from their content, while the company retains 40%
- Content Ownership: Teachers retain ownership of their content. The platform grants a non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content in connection with the Service.
- Content Guidelines: Teachers agree to comply with all content guidelines as provided by the platform. This includes avoiding copyrighted content, ensuring the accuracy of information, and promoting ethical and responsible teaching practices.
For Students
- Access to Assessments: Students are allowed to access assessments and receive answers, markings, and explanations from the AI Model. This includes assessments generated by teachers and quick assessments
5. Intellectual Property
- The Service and its content are protected by intellectual property rights, including copyrights, trademarks, and patents.
- You may not reproduce, modify, distribute, or commercially exploit any part of the Service without our express written consent.
- You acknowledge that all content on the Service, including but not limited to, questions, answers, explanations, and uploaded materials, is the property of its respective owner.
6. Prohibited Activities
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Interfere with or disrupt the Service.
- Attempt to access the Service through any means other than the provided interface.
- Reverse engineer, decompile, or disassemble the Service.
- Violate any applicable local, state, national, or international law or regulation.
7. Termination
- We may terminate or suspend your access to the Service at any time, for any reason, without prior notice.
8. Disclaimer
- The Service is provided "as is" and without warranty of any kind, express or implied.
- We do not guarantee the availability, accuracy, completeness, or reliability of the Service.
- We are not responsible for any loss or damage arising from your use of the Service.
9. Limitation of Liability
- To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service.
10. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of Kenya.
- Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of Kenya.

- We may amend these Terms at any time by posting the amended Terms on the Service.
- Your continued use of the Service after any changes have been made constitutes your acceptance of the amended Terms.
